GENERAL TERMS AND CONDITIONS ESCAPEROOM SCHIJNDEL
Article 1. Applicability
1.1 These general terms and conditions apply to all agreements between the partners, hereinafter referred to as ‘Escaperoom Schijndel,’ on the one hand, and visitors who make use of the services, facilities, and products offered by Escaperoom Schijndel, on the other hand. Nothing in these general terms and conditions is intended to affect your legal rights.
1.2 Escaperoom Schijndel may modify these general terms and conditions in whole or in part at any time. Visitors will be informed in a timely manner. If the visitor does not agree with the changes, they must notify Escaperoom Schijndel in writing within 10 working days from the day following the change of the general terms and conditions. Escaperoom Schijndel will endeavor to reach an appropriate solution.
1.3 The invalidity of any provision of these general terms and conditions does not affect the validity of the remaining provisions.
Article 2. Access
2.1 An order and/or reservation, whether oral or written, is binding. Escaperoom Schijndel reserves the right at all times to refuse orders and/or reservations or to impose additional conditions.
2.2 Information, such as notifications and price quotes, related to all activities of Escaperoom Schijndel is provided as accurately as possible. Additional costs, such as for reservations, payments, or arrangements, may apply. Escaperoom Schijndel accepts no liability for any inaccuracies or incompleteness in the provided price information.
2.3 Reservations can only be made through escapeschijndel.nl. If you need assistance or have questions, we are happy to help. You can reach us by phone at 06 57 36 86 66 or by email at info@escapeschijndel.nl.
2.4 After placing an order or reservation, you will receive a confirmation email containing all details of your order or reservation. If you do not receive a confirmation email, the reservation is not considered final. In that case, please contact us at 06 57 36 86 66.
2.5 We ask you to arrive 15 minutes before the start of the activity for the necessary instructions. Participants who do not arrive on time cannot participate in the activity. In this case, the full amount remains due.
Article 3. Cancellation or Rescheduling
3.1 Free cancellation is possible up to 7 days before the scheduled activity. If cancellation occurs later but up to 48 hours before the reservation, the reservation can only be rescheduled to another time within 3 months. Refunds are not possible. If a reservation is canceled within 48 hours of the scheduled activity, Escaperoom Schijndel has the right to charge 100% of the agreed price. Cancellation is only possible by emailing info@escapeschijndel.nl. You will always receive a cancellation confirmation.
3.2 In the event of force majeure, Escaperoom Schijndel may cancel or reschedule the order or reservation to another date. ‘Force majeure’ should be broadly interpreted and includes, but is not limited to, illness and/or cancellation of guidance, strikes, fire, adverse weather conditions, renovations, etc. Escaperoom Schijndel has the option to cancel or modify the reservation up to 24 hours before the start. In case of cancellation by Escaperoom Schijndel, the full amount will be refunded within 30 days.
Article 4. Liability
4.1 Participation is at your own risk. Escaperoom Schijndel is not liable for any damage, whether material or immaterial, that the visitor may suffer as a result of participation. Escaperoom Schijndel is not liable for loss, theft, or damage to property.
4.2 If, despite the provisions of the first paragraph of this article, liability of the organization for damage suffered by the visitor is assumed, the organization’s obligation to compensate that damage remains limited to the amount paid by the organization’s insurer for that damage.
4.3 The visitor indemnifies Escaperoom Schijndel against liability for damage that third parties may suffer as a result of actions, omissions, or conduct attributable to a visitor concerning or participation in the event.
Article 5. House Rules
5.1 Visitors must adhere to the house rules, regulations, and instructions of Escaperoom Schijndel and its staff. If the organization deems it reasonably necessary to maintain peace and order, it has the right to deny the visitor (further) access to the premises and remove them from the accommodation.
5.2 Children aged 12 and over are only admitted to Escaperoom Schijndel when accompanied by an adult.
5.3 To enable Escaperoom Schijndel to meet its legal obligations, visitors must be able to identify themselves upon request.
5.4 Digital cameras, video cameras, camcorders, phones (other than those owned by Escaperoom Schijndel), and other recording equipment are not allowed and are requested to be placed in the available locker. The key to this locker remains with your group.
5.5 Smoking is not allowed inside or around Escaperoom Schijndel.
5.6 The use of alcohol and/or drugs during or before the escape game is prohibited. If an Escaperoom Schijndel staff member doubts the condition of a visitor, they have the right to refuse that visitor without a refund.
5.7 If decoration, game elements, or other property of Escaperoom Schijndel are damaged or soiled during the game, costs will be charged. In case of theft of any of these items, a report will always be made to the police.
5.8 The enjoyment of an escape room includes solving puzzles. Allow your friends to have this enjoyment as well by sharing your experience but do not reveal the secrets. Consider yourself obligated to confidentiality.
Article 6
6.1 By entering into an agreement with Escaperoom Schijndel, (personal) data of the visitor may be collected, recorded, and stored in a database.
6.2 Escaperoom Schijndel handles the obtained (personal) data carefully and processes it solely in accordance with the Personal Data Protection Act.
6.3 By entering into the agreement with Escaperoom Schijndel, the participant expressly consents to the processing of (personal) data.
6.4 Escaperoom Schijndel may use the participant’s personal data to optimize its services and marketing for the event and future events.
6.5 During the escape room game, (video) recordings are made with security cameras, and the organization may provide these to third parties, including but not limited to the police and justice, in case of emergencies.
Article 8. Final Provisions
8.1 These general terms and conditions are exclusively governed by Dutch law.
8.2 Any disputes of any kind arising between a visitor and the organization concerning (the use or application of) these general terms and conditions and/or related agreements will first be submitted to the competent court in ‘s-Hertogenbosch.
